Moonshot Boxes Website Terms and Conditions

1. Usage Requirements

Moonshot Boxes Inc Offerings are available only to individuals who: (a) are over eighteen (18) years of age (or the applicable age of majority, if greater than eighteen (18) years of age in their respective jurisdictions of residence – for example, resident of the United Kingdom must be eighteen (18) or older, residents of Alabama and Nebraska must be nineteen (19) years of age or older and residents of Mississippi and Puerto Rico must be twenty-one (21) years of age or older); (b) can enter into legally binding contracts under applicable law; and (c) are residents of the United States, but not residents of the following states: Hawaii, Idaho, Michigan, Minnesota, Vermont or Washington (collectively, “Prohibited States”) (collectively, “Usage Requirements”). The Moonshot Boxes inc Offerings are not intended for individuals who do not satisfy the Usage Requirements, including individuals under eighteen (18) years of age (or the applicable age of majority, if greater than eighteen (18) years of age in their respective jurisdictions of residence), individuals who cannot enter into legally binding contracts under applicable law and/or individuals that do reside in a Prohibited State. If a User does not satisfy the Usage Requirements in their entirety, that User does not have permission to access or use the Moonshot Boxes inc Offerings. Residents of the states of Florida and New York may not be able to participate in certain Competitions Prizes.

In addition to the foregoing, employees of Moonshot Boxes inc, any of its affiliates, subsidiaries, holding companies, advertising agencies, or any other company or individual involved with the design, production, execution or distribution of the Moonshot Boxes inc Offerings and their immediate family members (spouse, parents, siblings and children, whether the relationship is by birth, marriage or adoption) and household members (people who share the same residence at least three (3) months of the year) are not eligible to participate in any Contests.

WITHOUT LIMITING THE FOREGOING, AND WITHOUT EXCEPTION, ALL PROSPECTIVE USERS ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR ENSURING THAT USE OF THE MOONSHOT BOXES INC OFFERINGS IS NOT PROHIBITED BY ANY LAW APPLICABLE TO THAT PROSPECTIVE USER’S RESIDENT JURISDICTION INCLUDING, WITHOUT LIMITATION, ANTI-MONEY LAUNDERING LAWS, GAMING LAWS, WITHOUT LIMITING THE FOREGOING, YOU REPRESENT AND WARRANT THAT MONEY THAT YOU USE TO PURCHASE TICKETS IS NOT TAINTED WITH ANY ILLEGALITY AND, IN PARTICULAR, DOES NOT ORIGINATE FROM ANY ILLEGAL ACTIVITY OR SOURCE, OR FROM ILL-GOTTEN MEANS

2. Wallet, Cryptocurrency, and Technology Requirements

Users shall be responsible, at all times, for obtaining and maintaining, at their sole cost and expense: (a) all necessary devices, equipment, and services for accessing the Moonshot Boxes Offerings; (b) functioning, USDT-compatible wallets accepted by Moonshot Boxes, such as Coinbase®, MetaMask®, Portis®, WalletConnect®, or a Moonshot Boxes custodial wallet (each, a “Wallet”); and (c) any cryptocurrencies accepted by Moonshot Boxes, such as USDT.

Moonshot Boxes does not guarantee the quality, speed, or availability of the Internet connection associated with any mobile device and/or computer. Moonshot Boxes does not guarantee that the Moonshot Boxes Offerings can be accessed: (i) on all mobile devices; (ii) through all wireless service plans; (iii) in connection with all Internet browsers; and/or (iv) in all geographical areas. Standard messaging, data, and wireless access fees may apply to use of the Moonshot Boxes Offerings through a wireless device. Users are fully responsible for all such charges, and Moonshot Boxes has no liability or responsibility to any User for any such charges billed by any wireless carrier.

In addition to the foregoing, individuals are not permitted to access the Moonshot Boxes Offerings with “Jail-Broken Mobile Devices.” For purposes of the Agreement, a Jail-Broken Mobile Device is a mobile device that runs: (A) Apple’s® iOS operating system (including the iPhone®, iPod touch®, iPad®, and second-generation Apple TV®) that has had any of its iOS-based software restrictions removed via any procedure that is not fully endorsed and authorized by Apple®; and/or (B) the Android® operating system that has had any of its Android®-based software restrictions removed via any procedure that is not fully endorsed and authorized by the applicable mobile device manufacturer.

Coinbase® is a registered trademark of Coinbase Global, Inc. (“Coinbase”). MetaMask® is a registered trademark of ConsenSys Software Inc. (“MetaMask”). Portis® is a registered trademark of ShapeShift Global Limited (“Portis”). WalletConnect® is a registered trademark of WalletConnect Inc. (“WalletConnect”). Please be advised that Moonshot Boxes is not in any way affiliated with Coinbase, MetaMask, Portis, or WalletConnect, and the Moonshot Boxes Offerings are not endorsed, administered, or sponsored by any of the foregoing entities.

3. Modification

To the extent permissible by applicable law, we may amend the Agreement from time to time in our sole discretion, without specific notice to you; provided, however, that: (a) any amendment or modification to the arbitration provisions, prohibition on class action provisions, or any other provisions applicable to dispute resolution (collectively, “Dispute Resolution Provisions”) shall not apply to any disputes incurred prior to the applicable amendment or modification; and (b) any amendment or modification to pricing and/or billing provisions (“Billing Provisions”) shall not apply to any charges incurred prior to the applicable amendment or modification. The latest Agreement will be posted on the Site, and you should review the Agreement, in its entirety, prior to each use of the Moonshot Boxes Offerings. By your continued use of the Moonshot Boxes Offerings, you hereby agree to comply with and be bound by all of the terms and conditions contained within the Agreement effective at that time (other than with respect to disputes arising prior to the amendment or modification of the Dispute Resolution Provisions, or charges incurred prior to the amendment or modification of the Billing Provisions, which shall be governed by the Dispute Resolution Provisions and/or Billing Provisions then in effect at the time of the subject dispute or incurred charges, as applicable).

4. Registration

To access Moonshot Boxes Offerings, you must first make an account for Moonshot Boxes for review and approval. Moonshot Boxes reserves the right to deny access at any time for any reason, as long as it is legally permissible.

The required registration data may include your email address, billing address (for credit card purchases), date of birth, credit card information, Wallet ID, and other requested details (collectively, "Site Registration Data"). Potential Competition winners may need to provide additional information, such as proof of identification, like a driver's license, passport, voting card, or similar government-issued ID ("Prize Winner Data").

You agree to provide accurate and complete Registration Data and update it as necessary through your Account settings. During registration, you will need to create a username and password for your Account login ("Log-In"). If your chosen Log-In is unavailable, you must select another. You can change your username and/or password at any time through your Account settings.

You are responsible for maintaining the confidentiality of your Account and Log-In details and for any activities conducted through your Account. If you suspect any security breaches, such as loss, theft, or unauthorized access to your password and Account details, you must notify Moonshot Boxes immediately.

5. The Competition

5.1 These terms and conditions apply to all competitions listed on the promoter’s website at www.moonshotboxes.com

5.2 All competitions are skill-based, and an entry fee is required for each participation.

5.3 To participate, each entrant ("Entrant") must correctly answer a question or solve a problem as set by the promoter (the "Competition Question").

6. How to Enter

6.1 Competitions run from the specified opening date ("Opening Date") to the closing date ("Closing Date") as detailed on the Website. All times and dates referenced are based on Greenwich Mean time (GMT).

6.2 The promoter reserves the right to adjust the Opening and/or Closing Dates if necessary. Any changes will be promptly updated on the Website.

6.3 Entries must be received by the promoter by the specified time on the Closing Date. Late entries will be disqualified and no refunds will be issued.

6.4 The maximum number of entries per competition will be stated on the Website. The promoter reserves the right to limit entries if this maximum is reached.

6.5 To enter a competition: (a) Select your Competition Box. (b) Answer the question correctly to proceed. (c) If your wallet address is required, enter it on the ‘Recipient Wallet Address’ section. (d) Purchase the desired number of entries (unlimited entries). (e) Multiple free entries are allowed, subject to limits set by the promoter.

6.6 The promoter accepts no responsibility for entries that are incomplete, lost, or delayed, regardless of the cause, including technical failures or other issues beyond the promoter's control.

6.7 By entering, you agree to be bound by these terms and conditions, forming a contract with the promoter.

7. Choosing a Winner

7.1 All correct entries will be entered into a random draw, and the winner will be selected as soon as reasonably possible, no later than 7 days after the Closing Date ("Draw Date").

8. The Prize

8.1 The prize ("Prize") for each competition is described on the Website. Prize details are accurate as of the Opening Date.

8.2 Prizes are subject to availability. The promoter reserves the right to substitute a prize of equal or greater value. Any changes will be updated on the Website.

8.3 The promoter makes no guarantees regarding the accuracy or completeness of Prize information provided on the Website.

8.4 Prizes may be provided by a third-party supplier ("Supplier"). Supplier details will be available on the Website.

9. Winners

9.1 The promoter’s decision is final, and no correspondence will be entered into.

9.2 The promoter will contact the winner via the provided email as soon as possible after the Draw Date. If the winner cannot be reached or fails to claim the Prize Within 14 days, the promoter may offer the Prize to the next eligible entrant.

9.3 The promoter is required to publish or make available the username of winners.

10. Claiming the Prize

10.1 The Prize will be sent automatically or Manually to the registered wallet address.

10.2 If your personal details change, notify the promoter as soon as possible at [email protected]. Include details of the competition entered, your old details, and your new details. If details change close to the Closing Date, the promoter may use the old details to contact you.

10.3 Any cash prize will be transferred to the winner's nominated wallet address. The winner may have to provide proof of account ownership. Failure to do so within 14 days may result in disqualification and forfeiture of the Prize, with the next eligible entrant selected.

10.4 The promoter accepts no liability if you are unable to claim or do not take up the Prize.

11. Collusion, Cheating, Fraud, Abuse, and Prohibited Behavior

11.1 Collusion It is prohibited for two (2) or more players to collaborate and/or collude during any contest and/or competition or to adopt a strategy (before or during a contest and/or competition) in order to mutually gain an advantage and/or harm other contest players and/or competition entrants, respectively (collectively, “Collusion”).

11.2. Cheating, Fraud, and Abuse

In accessing or participating in a contest and/or competition, you represent and warrant to us that you will not engage in any activity that interrupts or attempts to interrupt the operation of any contest, any competition, and/or the site, as applicable. Anyone who engages in, participates in, or displays behavior that may be interpreted, in our sole discretion, as unfair methods in participating in a contest and/or competition, and/or using the site, including, but not limited to, the opening and/or use of multiple accounts, the use of unauthorized or altered software or hardware to assist play (e.g., scripts, bots, bot nets, and collusion with bots), collusion with other users or third parties, deliberate transfer of money between accounts (e.g., “money laundering”), harassment of other users, breach of the agreement, breach of security of the subject account, or any other act (whether through the use of automated technology or otherwise) that unfairly alters a user’s chance of winning or constitutes the commission of fraud (collectively, “Abuse”), will be subject to immediate sanctions (as determined by us in our sole discretion), which may include, without limitation: (A) immediate account termination and blocking of access to the Moonshot Boxes offerings; (B) any contest prizes and/or competition prizes that the applicable user may otherwise have been entitled to receive shall be void and forfeited; and (C) any contest prizes and/or competition prizes received by the applicable user shall be subject to disgorgement and/or recoupment. In addition to the foregoing, we reserve the right to disclose or report any money laundering or similar illegal activity to law enforcement and regulatory authorities. Without limiting our other available remedies, we may institute or seek any injunctive relief, civil and/or criminal proceedings against any user and/or any co-conspirators arising out of or related to the commission of Abuse including, without limitation, recovering all of our fees and expenses (including reasonable attorneys’ fees) in connection with such efforts.

11.3. Hacking, Tampering, or Unauthorized Access

Any attempt to gain unauthorized access to our systems or any other user’s account, interfere with procedures or performance of a contest and/or competition, interfere with procedures or performance of the site, or deliberately damage or undermine any contest, any competition, and/or the site is subject to civil and/or criminal prosecution and will result in immediate termination of your account and forfeiture of contest prizes and/or competition prizes. You agree that you will not attempt to modify, alter, or tamper with the location settings of your mobile device/personal computer for any reason, or otherwise attempt to falsify your physical location through your mobile device/personal computer. You acknowledge that we are not responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access to or use of the Moonshot Boxes offerings or your account.

12. Data Protection and Publicity

12.1 By entering, you agree that personal information provided may be used by the promoter, its agents, and suppliers to administer the competition in accordance with the promoter’s Privacy Policy.

12.2 If you win, you consent to the promoter using your username, for publicity purposes. You agree to participate in reasonable publicity as requested by the promoter.

12.3 If you do not wish to participate in publicity, notify the promoter before the Closing Date. This will not affect your chance of winning, but the promoter may still need to provide your details to the Advertising Standards Authority.

12.4 If you win, you may be required to provide additional personal information and proof of identity. Refusal may result in forfeiting the Prize. The promoter may then offer the Prize to the next eligible entrant.

12.5 You may request that the promoter does not contact you or removes your details from its database. This will result in your withdrawal from the competition and forfeiture of any Prize. No refunds will be issued.

13. Interactive Services

In connection with your use of the Interactive Services, and other of the Moonshot Boxes™ Offerings, you agree not to: (a) display any telephone numbers, street addresses, last names, URLs, e-mail addresses or any confidential information of any third party; (b) display any audio files, text, photographs, videos or other images containing confidential information; (c) display any audio files, text, photographs, videos or other images that may be deemed indecent or obscene in your community, as defined under applicable law; (d) impersonate any person or entity; (e) “stalk” or otherwise harass any person; (f) engage in unauthorized advertising to, or commercial solicitation of, other Users; (g) transmit any chain letters, spam or junk e-mail to other Users; (h) express or imply that any statements that you make are endorsed by Moonshot Boxes™, without Moonshot Boxes’s™ specific prior written consent; (i) harvest or collect personal information of other Users whether or not for commercial purposes, without their express consent; (j) use any robot, spider, search/retrieval application or other manual or automatic device or process to retrieve, index, “data mine” or in any way reproduce or circumvent the navigational structure or presentation of the Moonshot Boxes™ Offerings; (k) post, distribute or reproduce in any way any copyrighted material, trademarks or other proprietary information without obtaining the prior consent of the owner of such proprietary rights; (l) remove any copyright, trademark or other proprietary rights notices contained on the Site; (m) interfere with or disrupt the Moonshot Boxes™ Offerings and/or the servers or networks connected to same; (n) post, offer for download, e-mail or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (o) post, offer for download, transmit, promote or otherwise make available any software, product or service that is illegal or that violates the rights of a third party including, but not limited to, spyware, adware, programs designed to send unsolicited advertisements (i.e., “spamware”), services that send unsolicited advertisements, programs designed to initiate “denial of service” attacks, mail bomb programs and programs designed to gain unauthorized access to mobile networks; (p) “frame” or “mirror” any part of the Site without Moonshot Boxes’s™ prior written authorization; (q) use metatags or code or other devices containing any reference to any Moonshot Boxes™ Offerings in order to direct any person to any other mobile application or website for any purpose; and/or (r) modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Moonshot Boxes™ Offerings or any software used in or in connection with the Moonshot Boxes™ Offerings. Moonshot Boxes™ reserves the right to pursue any and all legal remedies against Users that engage in the aforementioned prohibited conduct.

14. Social Media Pages

The Site contains links to various Social Media Pages. The Social Media Pages are hosted and made available by third-party entities on the Social Media Websites. Your use of Social Media Pages and Social Media Websites shall be governed by those Social Media Websites’ applicable agreements, privacy policies, and terms and conditions. You understand and agree that Moonshot Boxes™ shall not be liable to you, any other User, or any third party for any claim in connection with your use of, or inability to use, the Social Media Pages and/or Social Media Websites.

15. License Grant

As a User of the Site, you are granted a non-exclusive, non-transferable, revocable, and limited license to access and use the Moonshot Boxes™ Offerings and all other material, products, and/or services posted or made available by and through same (collectively, “Moonshot Boxes™ Material”) in accordance with the Agreement. Moonshot Boxes™ may terminate this license at any time for any reason. Unless otherwise expressly authorized by Moonshot Boxes™, you may only use the Moonshot Boxes™ Material for your own personal, non-commercial use. No part of the Moonshot Boxes™ Material may be reproduced in any form or incorporated into any information retrieval system, electronic or mechanical. You may not use, copy, emulate, clone, rent, lease, sell, modify, decompile, disassemble, reverse engineer, or transfer the Moonshot Boxes Material and/or any portion thereof. You may not create any “derivative works” by altering any aspect of the Moonshot Boxes™ Material. You may not use Moonshot Boxes™ Material in conjunction with any other third-party content (e.g., to provide sound for a film). You may not exploit any aspect of the Moonshot Boxes™ Material for any commercial purposes not expressly permitted by Moonshot Boxes™ (including the bundled sale of such Moonshot Boxes™ Material). Systematic retrieval of the Moonshot Boxes™ Material by automated means or any other form of scraping or data extraction in order to create or compile, directly or indirectly, a collection, compilation, database, or directory, though excluding systematic retrieval for the limited purpose of standard compilations (as is typically necessary or appropriate) for search engines like Google, without written permission from Moonshot Boxes™ is strictly prohibited. You further agree to indemnify and hold harmless Moonshot Boxes™ for your failure to comply with this Section 10. Moonshot Boxes™ reserves any rights not explicitly granted in the Agreement.

16. Proprietary Rights

All Moonshot Boxes™ Material is owned or licensed by or to Moonshot Boxes™, and is protected under applicable copyrights, trademarks, and other proprietary (including, but not limited to, intellectual property) rights. Except as expressly provided in the Agreement, no part of Moonshot Boxes™ Material may be reproduced, recorded, retransmitted, sold, rented, broadcast, distributed, published, uploaded, posted, publicly displayed, altered to make new works, performed, digitized, compiled, translated, or transmitted in any way to any other computer, website, or other medium or for any commercial purpose, without Moonshot Boxes’s™ prior express written consent. Except as expressly provided herein, you are not granted any rights or license to patents, copyrights, trade secrets, rights of publicity, or trademarks with respect to any of the Moonshot Boxes™ Material. The posting of information or material at the Site by Moonshot Boxes™ does not constitute a waiver of any right in or to such information and/or materials. Moonshot Boxes™ reserves all rights not expressly granted hereunder. The “Moonshot Boxes” name and logo are trademarks of Moonshot Boxes Inc. All custom graphics, icons, and service names are trademarks of their rightful owners. All other trademarks are the property of their respective owners. The use of any Moonshot Boxes™ trademark without Moonshot Boxes’s™ express written consent is strictly prohibited.

17. Indemnification

To the fullest extent permissible by applicable law, you agree to indemnify and hold Moonshot Boxes™, its parent and subsidiaries, and each of their respective shareholders, officers, directors, employees, agents, co-branders, content licensors, and/or other partners, harmless from and against any and all claims, expenses (including reasonable attorneys’ fees), damages, suits, costs, demands, and/or judgments whatsoever, made by any third party due to or arising out of: (a) your improper use of the Moonshot Boxes™ Offerings in any way whatsoever; (b) your breach of the Agreement; (c) any dispute between you and any other Users, Third-Party Providers, and/or other third parties; (d) any claim that Moonshot Boxes™ owes any taxes in connection with your use of the Moonshot Boxes™ Offerings; (e) your violation of any law including, without limitation, the Bank Secrecy Act and any and all other laws applicable to money laundering; and/or (f) your violation of any rights of another individual and/or entity. The provisions of this Section 15 are for the benefit of Moonshot Boxes™ and the Covered Parties. To the fullest extent permissible by applicable law, each of these individuals and entities shall have the right to assert and enforce these provisions directly against you on its own behalf.

18. Disclaimer of Warranties

THE MOONSHOT BOXES™ OFFERINGS, MOONSHOT BOXES™ MATERIAL, AND/OR ANY OTHER PRODUCTS AND/OR SERVICES OFFERED IN CONNECTION WITH SAME, ARE PROVIDED TO YOU ON AN “AS IS” AND “AS AVAILABLE” BASIS AND ALL WARRANTIES, EXPRESS AND IMPLIED, ARE DISCLAIMED TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW (INCLUDING, BUT NOT LIMITED TO, THE DISCLAIMER OF ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY AND/OR FITNESS FOR A PARTICULAR PURPOSE). IN PARTICULAR, BUT NOT AS A LIMITATION THEREOF, MOONSHOT BOXES™ MAKES NO WARRANTY THAT THE MOONSHOT BOXES™ OFFERINGS, MOONSHOT BOXES™ MATERIAL, AND/OR ANY OTHER PRODUCTS AND/OR SERVICES OFFERED AND/OR ACCESSED IN CONNECTION WITH SAME: (A) WILL MEET YOUR REQUIREMENTS; (B) WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED; (C) WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (D) WILL HAVE SECURITY METHODS EMPLOYED THAT WILL BE SUFFICIENT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF SAME, OR AGAINST INFRINGEMENT; (E) WILL RESULT IN ANY FINANCIAL BENEFIT OR GAIN; AND/OR (F) WILL BE ACCURATE OR RELIABLE. THE MOONSHOT BOXES™ OFFERINGS, MOONSHOT BOXES™ MATERIAL, AND/OR ANY OTHER PRODUCTS AND/OR SERVICES OFFERED IN CONNECTION WITH SAME MAY CONTAIN BUGS, ERRORS, PROBLEMS, OR OTHER LIMITATIONS. MOONSHOT BOXES™ WILL NOT BE LIABLE FOR THE AVAILABILITY OF THE UNDERLYING INTERNET CONNECTION ASSOCIATED WITH THE SITE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM MOONSHOT BOXES™, ANY USERS, THIRD PARTY CONTENT PROVIDERS OR OTHERWISE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE AGREEMENT. FURTHER, EACH USER UNDERSTANDS AND AGREES THAT OWNERSHIP OF, AND TRANSACTIONS INVOLVING, USDT AND/OR A MOONSHOT BOXES™ NFT MAY REQUIRE OR RELY ON THIRD-PARTY TECHNOLOGY AND/OR PLATFORMS INCLUDING, WITHOUT LIMITATION, DIGITAL WALLETS, BLOCKCHAINS OR RELATED TECHNOLOGY, SMART CONTRACTS, INTERNET SERVICE PROVIDERS, MARKETPLACES, EQUIPMENT, OR OTHER INFRASTRUCTURE (COLLECTIVELY, “THIRD PARTY TECHNOLOGY”). EACH USER UNDERSTANDS AND AGREES THAT THE EXISTENCE AND PERFORMANCE OF THIRD PARTY TECHNOLOGY IS OUTSIDE OF MOONSHOT BOXES’S™ CONTROL. TO THE MAXIMUM EXTENT PERMISSIBLE UNDER APPLICABLE LAW, MOONSHOT BOXES™ DISCLAIMS ALL LIABILITY FOR THE USE, UNAVAILABILITY, AND/OR FAILURE OF ANY THIRD PARTY TECHNOLOGY.

19. Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT MOONSHOT BOXES™ SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, AND/OR EXEMPLARY DAMAGES INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF MOONSHOT BOXES™ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), TO THE FULLEST EXTENT PERMISSIBLE BY LAW FOR: (A) THE USE OR THE INABILITY TO USE THE MOONSHOT BOXES™ OFFERINGS, MOONSHOT BOXES™ MATERIAL, AND/OR ANY OTHER PRODUCTS AND/OR SERVICES OFFERED IN CONNECTION WITH SAME; (B) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND/OR SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION, CONTENT, AND/OR ANY OTHER PRODUCTS PURCHASED OR OBTAINED FROM OR THROUGH THE SITE; (C) THE UNAUTHORIZED ACCESS TO, OR ALTERATION OF, YOUR REGISTRATION DATA; (D) YOUR FAILURE TO REALIZE ANY FINANCIAL BENEFIT OR GAIN; (E) THE CANCELLATION OF ANY CONTEST(S) AND/OR PRIZES, AS PERMITTED HEREUNDER OR UNDER THE RULES; (F) UNAUTHORIZED ACCESS TO A MOONSHOT BOXES™ NFT AND/OR A MOONSHOT BOXES™ NFT’S ASSOCIATED DIGITAL OBJECT; (G) ANY UNAUTHORIZED THIRD PARTY ACTIVITIES INCLUDING, WITHOUT LIMITATION, THE USE OF VIRUSES, PHISHING, BRUTE FORCING, OR OTHER MEANS OF ATTACK AGAINST A BLOCKCHAIN NETWORK UNDERLYING USER WALLETS, MOONSHOT BOXES™ NFTS, AND/OR MOONSHOT BOXES™ NFTS’ ASSOCIATED DIGITAL OBJECTS; AND/OR (H) ANY OTHER MATTER RELATING TO THE MOONSHOT BOXES™ OFFERINGS, MOONSHOT BOXES™ MATERIAL, AND/OR ANY OTHER PRODUCTS AND/OR SERVICES OFFERED AND/OR ACCESSED IN CONNECTION WITH SAME. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION, IN THE AGGREGATE INCLUDING, BUT NOT LIMITED TO, BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY, MISREPRESENTATIONS, AND ANY AND ALL OTHER TORTS. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, YOU HEREBY RELEASE MOONSHOT BOXES™ FROM ANY AND ALL OBLIGATIONS, LIABILITIES, AND CLAIMS IN EXCESS OF THE LIMITATIONS STATED HEREIN. IF APPLICABLE LAW DOES NOT PERMIT SUCH LIMITATION, THE MAXIMUM LIABILITY OF MOONSHOT BOXES™ TO YOU UNDER ANY AND ALL CIRCUMSTANCES WILL BE FIVE HUNDRED DOLLARS ($500.00). THE NEGATION OF DAMAGES SET FORTH ABOVE IS A FUNDAMENTAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN YOU AND MOONSHOT BOXES™. ACCESS TO THE MOONSHOT BOXES™ OFFERINGS, MOONSHOT BOXES™ MATERIAL, AND/OR ANY OTHER PRODUCTS AND/OR SERVICES OFFERED IN CONNECTION WITH SAME WOULD NOT BE PROVIDED TO YOU WITHOUT SUCH LIMITATIONS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS ON LIABILITY AND, IN SUCH JURISDICTIONS, MOONSHOT BOXES™ LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

20. Legal Warning

If you bypass or disable any portion of the Moonshot Boxes™ Offerings or associated software, including, without limitation, the operation of Moonshot Boxes™ systems, or you attempt to circumvent or tamper with the Contests, or billing methods in any way, you are in violation of the Agreement and Moonshot Boxes™ may suspend or terminate your Account without notice. Termination of your Account will not excuse you from any criminal or other civil liabilities that may result from your actions.

21. Third-Party Websites

The Moonshot Boxes™ Offerings may provide links to other Internet websites and/or resources, including, without limitation, Social Media Websites and websites owned and/or operated by Third Party Providers. Because Moonshot Boxes™ has no control over such third-party websites and/or resources, you hereby acknowledge and agree that Moonshot Boxes™ is not responsible for the availability or content of such third-party websites and/or associated resources. Furthermore, Moonshot Boxes™ does not endorse, and is not responsible or liable for, any terms and conditions, privacy policies, content, advertising, services, products, and/or other materials available at or from such third-party websites or resources, or for any damages and/or losses arising therefrom or associated therewith.

22. Miscellaneous

Should any part of the Agreement be held invalid or unenforceable, that portion shall be construed as closely as possible to its original intent while consistent with applicable law, and the remaining portions shall remain in full force and effect. The Agreement is personal between you and Moonshot Boxes™ and it governs your use of, and access to, the Moonshot Boxes™ Offerings and Moonshot Boxes™ Material. To the extent that anything in or associated with the Moonshot Boxes™ Offerings is in conflict or inconsistent with these Terms and Conditions, these Terms and Conditions shall take precedence; provided, however, that with respect to any: (a) Contest, to the extent that anything in these Terms and Conditions is inconsistent with the applicable Contest Rules, those Contest Rules shall take precedence; and (b) Contests, to the extent that anything in these Terms and Conditions is inconsistent with the applicable Contest Rules, those Contest Rules shall take precedence. Moonshot Boxes™' failure to enforce any provision of the Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision. The parties do not intend that any agency or partnership relationship be created through operation of the Agreement. We may assign the Agreement, and any rights and obligations hereunder, in whole or in part, at any time without notice to you. You may not assign the Agreement or transfer any rights to use the Moonshot Boxes™ Offerings.
